C. Chisom Photography Terms of Service

When you purchase a session, you are agreeing to all of the following terms:

1. Entire Agreement

This agreement contains the entire understanding between C. Chisom Photography ("Photographer") and the client ("Client"). It supersedes all prior and simultaneous agreements between the parties. Any additions or modifications to this agreement must be made in writing and signed by all parties.

2. Payment & Prices

All costs are as stated at the time of booking and will not change once the booking is confirmed. A retainer is required to reserve your date, and the remaining balance is due the day of the session or event.

  • Retainers are non-refundable and non-transferable.
  • Once a session has taken place, no refunds will be issued.
  • C. Chisom Photography maintains a strict NO REFUND policy.

3. Rescheduling & Cancellations

  • Clients may reschedule with at least 24 hours' notice unless due to illness.
  • If a client reschedules or cancels three times, they forfeit their deposit. To rebook, payment in full will be required, and it will be non-refundable and non-transferable.
  • No-call/no-show clients forfeit any money paid. Any future sessions must be paid in full and are non-refundable.

4. Weather Conditions

If torrential weather occurs and the Photographer determines the shoot is not possible, the session will be rescheduled.

5. Personal Cameras & Additional Photographers

  • Personal cameras, cell phones, and other recording devices are not permitted during sessions. If used, the Photographer will request they be put away.
  • No other professional photographers may work an event C. Chisom Photography is scheduled to cover unless employed by C. Chisom Photography.

6. Requested Coverage

The Photographer will honor requested photographs but does not guarantee the capture of any specific image, editing style, or pose.

7. Artistic Style

By booking, the Client acknowledges that they are familiar with the Photographer’s style and are booking based on that style. Variations in location, lighting, and subjects will affect the final outcome.

  • Photographer reserves full creative and artistic discretion.
  • Heavy editing (e.g., body modifications, object removal) is available at an additional charge and at the Photographer’s discretion.
  • Some images may be delivered in color or black and white.
  • No re-edits will be provided.

8. Cooperation & Liability

  • All parties agree to cheerful cooperation and communication.
  • Photographer is not responsible for missed images due to any participant’s non-cooperation or absence.
  • Any threat to the Photographer, their equipment, or team will result in immediate termination of coverage with no refund.
  • Client assumes full responsibility for themselves and all session participants.
  • Any damage to equipment or props caused by the Client is the Client’s financial responsibility.
  • Client agrees to hold Photographer harmless for any injuries or damages sustained before, during, or after the session.

9. Copyright & Reproduction

  • The Photographer retains full copyright to all images.
  • Images may be used for the Photographer’s portfolio, marketing, social media, contests, exhibitions, or studio display.
  • Clients are prohibited from altering images in any way, including adding filters or cropping. Violation may result in revocation of gallery access.
  • RAW files will never be released.

10. Substitute Photographer

In case of illness or emergency, the Photographer may substitute a competent professional photographer to complete the assignment.

11. Limit of Liability

In the unlikely event that the Photographer cannot perform due to medical emergency, natural disaster, or uncontrollable circumstances, the Client’s deposit and any paid funds will be refunded.

Photographer’s liability is limited to the return of any payments received and shall not exceed the retail value of the Client’s order.

Photographer is not liable for loss or damage of photographic materials without fault.

12. Chargebacks

Booking with C. Chisom Photography constitutes acknowledgment and acceptance of all Terms and Conditions, including the no-refund policy.

  • In the event of a chargeback dispute, C. Chisom Photography reserves the right to submit evidence including, but not limited to, booking receipts, invoices, and these Terms and Conditions.

13. Inherent Qualities

Client understands that photographic dyes and materials may fade or discolor over time, and releases Photographer from liability for fading or discoloration.

  • Client is responsible for downloading all digital images within 45 days of gallery delivery. After 45 days, images may be deleted without further notice.
  • Wedding galleries will remain available for six (6) weeks after delivery; after this period, galleries may be deleted.

14. Turnaround Time

  • General sessions: 3–5 weeks.
  • Peak season (April-June & September–December): 4–6 weeks.
  • Weddings: 16+ weeks.
  • Delays due to illness, rescheduling, or unforeseen circumstances may impact delivery time.
  • Turnaround times are estimates, not guarantees.
